The FMLA is a federal law that provides eligible employees with up to 12 weeks of unpaid leave in a 12-month period if they can’t work due to a serious health condition or because they must care for a family member who has a serious health condition. The FMLA also covers time off due to pregnancy and for time to bond after childbirth.
When Can the FMLA Be Enforced?
The following four scenarios will qualify a worker to request leave under the FMLA:
- The birth or adoption of a child
- The employee has need to take care of their spouse child, or parent who has a serious health condition
- The employee has a serious health condition that is preventing them from performing their job responsibilities
- The worker has a qualifying need related to a spouse, child, or parent who is in the military and called to covered active duty status.
FMLA Eligibility Requirements
The FMLA doesn’t cover everyone. If you want to file an FMLA claim, you must work for an FMLA-covered employer, such as a private sector entity, public agency, or school. Private employers must employ “50 or more employees in 20 or more workweeks in the current or previous calendar year.” Employees must work for their employer for at least 12 months in order to be eligible for FMLA leave. Employees must also have worked 1,250 hours within that period to qualify.
